Coaching Agreement

Nature of the coaching relationship: Coaching is a process in which the client wishes to achieve personal growth in their life and the coach is there to act as a guide and to provide structure and method to the process of analysing the challenge and aiding the client in developing strategies and ways of thinking to accomplish this change. It is the client who achieves change, the coach can not ever do this for the client.

Coaching can involve any aspect of the client’s life, including mental, emotional, physical, relational and financial. The client retains full responsibility for all of these, their own wellbeing and is solely responsible for any actions or decisions they take as a result of the coaching process. The client recognises that the coach is not and can not be held liable for any action or inaction or any direct or indirect result of the coaching process. The client recognises that coaching cannot ‘cure’ anything, mental or physical and is not a replacement for therapy or medical help.

Scope of Services: The Client has engaged the Coach for the services outlined in this Agreement. The Coach agrees to provide these specified services. Any additional services not included in this Agreement may require a separate agreement agreed upon by both parties.

Additional Services: The Coach may offer additional services to the Client, which may include but are not limited to: reading or writing reports, reviewing documents, or communication and engagement with the Client outside of scheduled coaching hours. These Additional Services will be provided upon written request to the Coach. The Coach will provide price quotes for any Additional Services requested at that time.

Coach and Client Schedule: The date, time, and location of the Coaching Services will be mutually agreed upon by both the Coach and the Client. The Coach will provide the Services at times and locations that are convenient for both parties. Additionally, the Coach will observe their own holidays, and these will be taken into consideration when scheduling sessions.
The Client and Coach Relationship: The Parties understand that the Client - Coaching relationship is a partnership or alliance between the Client and Coach. This Client-Coach relationship is an alliance and not a legal relationship.The Client acknowledges and understands the Services of the Coach is an inclusive and comprehensive process that may delve into certain areas of the Client’s personal life, including but not limited to, the Client’s life, relationships, career, education, recreation, fitness, and finances. The Client fully acknowledges that it is his or her ultimate personal decision as to how he or she decides to implement the Coach’s services, techniques, advice into such his or her life.

The Client acknowledges and understands that the Services rendered by the Coach is not therapy and under no circumstances is it a substitute for therapy if needed. Further, the Coach and Services does not diagnose, cure, prevent, or treat any mental disease or disorder.
Duties and Responsibilities of the Coach and Client:The Coach and Client agree to uphold their respective obligations under this Coaching Agreement. Both parties acknowledge that fulfilling these responsibilities and duties is essential for a successful coaching relationship.

The Coach agrees to adhere to industry standards, including maintaining professional membership and participating in regular supervision.

The Client agrees to maintain efficient and reasonable communication with the Coach. The Client also commits to providing honest feedback and fully engaging in the Coach’s program and services.
Record Keeping and Data Protection: The coach may take notes in sessions in order to better understand the client and aid in preparation for subsequent sessions. These notes will never be passed on to a third party. Any notes will be retained for the period of coaching, and then a period of 3 years, in case the client wishes to return to coaching at a later date. Within our strict code of confidentiality, the coach will need to keep your name, contact details, and attendance data on record. 

The coach keeps a record of all appointments offered, attended, and cancelled, and of the payments made. I do this so that we can run an efficient appointments system and make sure that the services are safe for everyone. Subject to local regulation, You have a right to see all of your notes and records. 

If you would like to see the information that the coach may have about you, please ask at any point throughout the coaching process. In accepting the offer of coaching you agree to these records been kept.
Cancellation Policy: The Client must provide a minimum of twenty-four (24) hours' notice to cancel or reschedule a Coach Session ("Session"). Notice must be given by confirmed in writing. If the Client cancels or reschedules within twenty-four (24) hours of the scheduled Session, the full cost of the Session will be charged.

If the Coach needs to cancel a scheduled Session, the Coach will provide at least twenty-four (24) hours' notice by phone and confirm in writing. If the Coach fails to give the required notice, the Client will receive one (1) free Session for each occurrence.
Terms and Termination: This Coaching Agreement may be terminated at any time by mutual agreement between the Coach and the Client. The agreement shall be effective from the date hereof and will continue until terminated by either party.

The Client understands that the Coach may terminate this Agreement at any time if the Client fails to pay for the Services provided under this Agreement or breaches any other material provision of this Agreement. The Client agrees to pay any outstanding balances within 7 days of termination.
Confidentiality: Maintaining confidentiality and building trust between us is crucial. Everything we discuss during our sessions will remain completely confidential and will not be shared outside of our sessions, except in specific cases where I may discuss session issues with my mentor or coach, ensuring anonymity is preserved.

Any information exchanged under this Agreement, including its attachments, is strictly confidential. Neither the Coach nor the Client has the right to disclose any details about the Agreement or the Services provided. Breaching this confidentiality is a serious violation of this Coaching Agreement and may result in legal action.

It's important to note that this Client-Coach Agreement does not provide legal confidentiality protection. Therefore, the Coach may need to disclose otherwise confidential information to authorities if necessary.
Limited Liability: The Coach does not provide any guarantees, warranties, or representations, whether express or implied, regarding the Services outlined in this Agreement. The Coach shall not be held liable to the Client for any special, direct, or consequential damages.

Regardless of any damages incurred, the Coach's liability under this Agreement and the Client’s sole remedy shall be limited to the total amount paid by the Client to the Coach for all Services rendered during the term of this Agreement, including up to the date of termination. The Client acknowledges that the Coach is not liable for any actions or inactions, or for any indirect or direct consequences resulting from the Services provided.
Dispute Resolution: If at any time you experience dissatisfaction with the coaching process, it is best to bring it up with the coach and attempt to overcome any obstacles that have arisen. The coach and client undertake in good faith to resolve any problems to the best of their ability and to the satisfaction of both parties. If in the unlikely event a problem still remains, we recommend that the parties seek mediation from an impartial third party.
Severability: If any part of this Agreement is deemed invalid, illegal, or unenforceable in any jurisdiction, it will not affect the validity, legality, or enforceability of the remaining parts of the Agreement. The invalid or unenforceable part will be interpreted in a manner consistent with applicable law to reflect the original intent as closely as possible.
Entire Agreement: This Agreement constitutes the sole and entire agreement between the Parties regarding the subject matter contained herein, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter. This Agreement may only be amended, modified, or supplemented by a written agreement signed by each Party.

Client Agreement

I am motivated and committed to the coaching process. I understand that in order to achieve results, my full participation and commitment will be required. I accept full responsibility for myself and any actions I take that might result from Coaching and I promise that I am healthy enough physically and mentally to engage in coaching. I know that I must take responsibility for my life in order to empower myself to achieve the change I wish to make and that no one else can do this for me. I can afford the Coaching fee at this time. I agree to honour my scheduled session times, and I can afford the fees for coaching at this time. If my circumstances change I will tell my coach as soon as possible. I have read and agree with the Coaching Agreement.
As a client, I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my coaching sessions, including my choices and decisions. I am aware that I can choose to discontinue coaching at any time.
I understand that coaching is a Professional-Client relationship I have with my coach that is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

I understand that coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education and recreation. I acknowledge that deciding how to handle these issues, incorporate coaching into those areas, and implement my choices is exclusively my responsibility.

I understand that coaching does not involve the diagnosis or treatment of mental disorders. I understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy. If I am currently receiving psychiatric care, I will consult with my caregiver to ensure working with a coach is in my best interest at this time.

I understand that information will be held as confidential unless I state otherwise, in writing, except as required by law. I understand that if I reveal information that involves physically hurting myself or others, the coach must report such information and/or refer to mental health professionals accordingly.
 
I understand that certain topics may be anonymously and hypothetically shared with other coaching professionals or clients for training, educational OR consultation purposes and that Jenn Taylor will take great care to change any identifiable details to protect my privacy.
 
I understand that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business or other qualified professionals. I will seek independent professional guidance for legal, medical, financial, business or other matters. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my sole responsibility.
